General Terms and Conditions for the Performance of Training Courses of Computare GmbH
These General Terms and Conditions apply to training courses carried out by Computare GmbH (hereinafter referred to as "Computare").
Training courses are advertised and offered by Computare as public courses and as customer training courses.
The form of the training is either a classroom course (frontal teaching or workshop) or an e-learning course.
Public courses are open to the general public. A company can also send individual employees to public courses. training content, dates and location are published by Computare via the Internet or in print form.
Customer training courses are only carried out on behalf of a customer for his employees. The training contents, duration, dates, price and location are created together with the customer and offered in writing. These courses are subject to VAT.
Registration and confirmation
Registration for a public training course must be made in writing, by post, e-mail or via the Internet contact form to Computare. The registration must contain the following information:Name and complete company address of the participant - if available -, complete billing address as well as course title, date and location.
Registrations received by Computare will be considered in the order in which they are received.
A written confirmation will be sent immediately after receipt of the order. Only then is the order binding.
The confirmation of order includes all details regarding price, date and time of the training course as well as the venue and must be checked by the customer within one calendar week and, if necessary, a written complaint must be made, otherwise the order is valid under the conditions confirmed by Computare.
For organizational reasons, we reserve the right to postpone or combine classes, change the location of the course or shorten courses with a percentage refund of the course fee.
If a course leader fails, the school management can change the course leader or appoint a substitute.
Course locations and implementation
In order to be able to conduct our courses under optimal conditions, we set a minimum and a maximum number of participants for each learning offer. Places on courses are allocated in the order in which registrations are received (subject to timely payment).
If the number of participants is insufficient, the course will generally not be held and the course fee will be waived or refunded.
If there is a shortage of class places, it may happen in individual cases that we conduct the course subject to the agreement of the course participants, but increase the course fee accordingly or, where appropriate, reduce the number of lessons.
Computare GmbH reserves the right to exclude one or more course participants from a course for good reason. In the following cases the entire course fee is due, i.e. there will be neither a pro-rata refund nor a remission of the course fee: exclusion from the course due to non-payment of the course fee and in serious cases (defamation, harassment, deliberate damage to property etc.).
Cancellation by Computare
Computare reserves the right to change or cancel training dates. If a training course is cancelled by Computare, the customer will be informed in writing at least 5 working days before the start of the training. Possible claims for damages are excluded.
Cancellation by course participants
The registration is binding. In case of inability to attend the course, the course participant can change or cancel his or her registration in writing (letter or e-mail) up to 10 working days before the start of the course without incurring any costs.
In case of cancellation after this deadline, the following conditions apply:
2.6.1 Less than 10 working days -50% of the total course costs are due.
2.6.2.Less than 3 working days -100% of the total course costs are due.
2.6.3.Absence from the course -100% of the total course costs are due.
2.6.4.The rebooking to a substitute participant is possible.
2.6.5.After the start of the course the course fee will not be refunded.
The prices for public training courses are per participant and will be published with the respective training descriptions. The prices for the training documents and the examination fee are listed separately. The prices are generally exempt from VAT, as these are school services.
Lessons not attended
Lessons not attended cannot be made up and are not refundable.
At your request and after you have attended at least 80 percent of the course lessons, we will be happy to issue you with a course confirmation or enter your attendance in the Swiss Association for Continuing Education's (SVEB) education pass. In both cases, however, it is a condition that your course did not take place more than one year ago.
Placing of orders
Customer training courses are ordered by a company for its employees. Training content, duration and location of customer training courses are discussed with the customer and then offered.
If the offer is accepted and confirmed in writing - via e-mail or letter, the service is confirmed in writing - via e-mail or letter - by Computare. This confirmation contains the details regarding the training such as price, date, location and title.
This confirmation has to be checked carefully by the client. Any discrepancies must be indicated immediately in writing. Otherwise the confirmation is deemed to have been accepted on the conditions confirmed by Computare.
Withdrawal or rebooking
The customer may cancel or postpone a training course free of charge up to 15 working days before the contractually agreed start of the training course at the latest. If a declaration of cancellation is made later than 15 working days before the start of the training course, the customer must pay the full training fee. The cancellation or rebooking must be made in writing.
Unless otherwise agreed, the invoice will be issued 10 days before the start of the training course and is due immediately and without deduction after the service has been provided.
For all courses and events organized by Computare GmbH we exclude any liability for damages incurred. You are therefore responsible for providing sufficient insurance coverage. The use of the premises of Computare GmbH is at your own risk. Computare GmbH cannot be held liable for theft and loss of objects.
Computare reserves all rights to the course documents, this also applies to the translation, reprinting and reproduction of the training documents or parts thereof. No part of the training documents may be reproduced in any form, including for the purposes of your own course design, without written permission from Computare.
Confidentiality and data protection
Customer data is collected by Computare and used for internal purposes only. Computare undertakes not to pass on the data to third parties and to keep all information confidential.
The legal basis for the handling of personal data of the customer is the Swiss Data Protection Ordinance. Personal data of the customer will only be collected, processed or used if the person concerned has given his or her consent or if the Swiss Data Protection Ordinance or another legal provision orders or allows it.
Photo, video and audio recording
No photographs, video or audio recordings may be made on the premises of Computare GmbH without the express consent of Computare GmbH and/or the course participants.
Program and price changes
We reserve the right to make program and price changes as well as changes in the general terms and conditions.
Applicable law/court of jurisdiction
Each training order is subject to Swiss law. Place of jurisdiction is Arlesheim BL.
Should provisions of these General Terms and Conditions or other agreements be wholly or partially invalid, unenforceable or incomplete, they shall be replaced or a gap in the provisions shall be filled by a rule which, from a reasonable, objective point of view, leads to an appropriate balance of interests for both parties. Should the parties to the contract be unable to reach agreement despite this rule, Swiss law shall apply.
